The second Customs and Tax Amnesty in Honduras 2018

By Decree No. 51-2018 of June 6, 2018, the second Customs and Tax Amnesty of the present year was issued, published in the October 6, 2018 edition in the Official Gazette, containing the following benefits:

  1. Tax Regularization
  2. Customs and Tax amnesty
  3. Amnesty Honduran Institute of Social Security (IHSS)
  4. Telecommunications amnesty
  5. Vehicular amnesty
  6. Amnesty and condonation of customers of the National Electricity Company (ENEE)
  7. Amnesty and condonation of customers of the National Autonomous Service of Water and Sewer Systems (SANAA).

The present Decree was approved in order to benefit citizens obliged to pay, without surcharges or fines, debts such as Income Tax (I.S.R.), Sales Tax (I.S.V.), vehicular and customs taxes. This amnesty can accommodate any natural or legal person who has outstanding fines, surcharges, or any type of delay in their tax obligations. Furthermore, the Tax Regularization of the fiscal years 2013, 2014, 2015, 2016 was approved, by which any natural or juridical person that is not in default with the Treasury can be regularized by paying an amount equal to 1.5% of the highest gross annual income earned within the fiscal years listed above.

It should be noted that previously the amnesty covered 5 fiscal periods but the 2017 period has now been excluded.  We specifically recommend that large taxpayers be regularized since they are the ones with the highest fiscal risk, and by carrying out this procedure such large companies protect themselves from possible audits that the Tax Administration intends to carry out, which usually entail the imposition of adjustments amounting to vast sums of money. The present Decree will be valid for sixty (60) business days from the day of its publication in the Official Gazette La Gaceta, with the exception of Article 9 of this Decree, which is valid for six (6) months from the date of publication.
