At the request of the Paris office of the international law firm White & Case, BLP has engaged in research into the sexual abuse of minors in Honduras.   The information obtained is required for an investigation at the Latin American level and per the solicitation by White & Case is being conducted as pro-bono work.

Attorney José Miguel Álvarez, Partner in Honduras supported the investigation by drafting the theoretical framework of the case based on the provisions of the Honduran Criminal Code. He was aided by Associate Ivis Alvarado, also of Honduras.

Being a minor in Latin America means always being at risk. The number of cases of transgressions against minors by people who take advantage of their vulnerability has been increasing. About 1.1 million of our children and adolescents up to 17 years of age have been victims of sexual violence at some point in their lives.

In Honduras in 2017, more than two thousand cases of sexual abuse were reported, posing the question whether our society has become hyper-sexualized distorting the nature of the human race itself, and asking the part that such factors as family disintegration and lack of sex education play.

Honduran law establishes penalties of 15 years for rape and 5 to 8 years for acts of lust, both crimes can be aggravated and, therefore, receive a greater penalty. However, in many cases, the victims do not finish the process because they feel re-victimized during the investigation or trial. At other times, these crimes are not prosecuted due to lack of complaints to the proper authorities.
